Strata Property Act – Section 35
Records a Strata Corporation Must Prepare & Retain

The Strata Property Act establishes a transparent, democratic governance framework. Under section 35 every strata corporation must prepare and keep the following records.

Part 4 · Division 1 — The Council

35 (1)  Records to Prepare

  • Minutes of annual, special, and council meetings (including vote results)
  • List of council members
  • Ownership register containing
    • Strata-lot & mailing addresses, lot numbers, parking / locker numbers, unit entitlements
    • Mortgagees who filed a “Form C – Mortgagee’s Request for Notification”
    • Names of tenants
    • Assignments of voting or other rights (ss. 147–148)
  • Books of account showing all money received / spent and reasons for each entry
  • Any additional records required by regulation

35 (2)  Records to Retain (copies)

  • All subsection (1) records
  • Registered strata plan & amendments (Land Title Office)
  • Strata Property Act, Regulations, bylaws & rules
  • Resolutions affecting common property / LCP designations
  • Waivers & consents under ss. 41, 44 or 45
  • Written contracts to which the corporation is party
  • Arbitration / court / CRT decisions & legal opinions
  • Current & past budgets and financial statements
  • Income-tax returns (if any)
  • All strata correspondence (sent & received)
  • Bank statements, cancelled cheques, certificates of deposit
  • Information Certificates issued under s. 59
  • Records obtained under ss. 20 or 23
  • Depreciation reports (s. 94)
  • Major-item reports (engineers, risk, sanitation, etc.) & electrical planning reports (s. 94.1)
  • Reports on installation / operation of EV-charging infrastructure or related electricity management
  • Any additional records required by regulation

35 (3)  Retention Periods
All records must be kept for the minimum periods set out in the Regulations.
